      Hi Guys,

      I trust you are all doing well!

      I want to open a cannabis social club with themed “events” to be held at a residential property (in a beautiful nature setting) – what do you think of the below concept and does it pose any legal problems?

      Here are some key features:

      – You do not have to be a “member” as such but have to book and pay a ticket (online) for the event beforehand (this will be the operating model, but to gain momentum at the start when launching it will probably be free to book with payment upon entry..). The price will include entry to the event, food and drink (non alcoholic).

      – Strict BYO policy: Bring your own cannabis, it’s not for sale.. This model is not a co-op or grow-op. It’s for regular cannabis users in the area (that have their own supply) that want to socialise in a beautiful setting, with a great atmosphere, awesome food and chill music.

      – Uber only: Since it will be in a residential area and there will likely be a backlash from conservative types who fear there will be intoxicated stoned drivers in the neighbourhood, it is best to keep the peace and let attendees be dropped off and picked up.

      Since consuming cannabis in the privacy of your own property is legal, are there any exceptions that could affect the above social cannabis club concept?

      Any advice would be greatly appreciated!

      Hey Anton,

       

      This is a cool concept, Suresh identified it as the “Stokvel” club, which works on the basis of a group of friends coming together to smoke their own dagga. No problem with that.

      I’d just be careful about calling it a club, but it doesn’t have members or operations or agreements in place. How many people do you want to invite to these events? And will they all be known to you or will you be opening it to anyone who can buy a ticket?

      You’ll basically be hosting a party with food and entertainment, where consumption of weed is allowed. Why then call it a club? A DPC is mainly for the purpose of growing as collective, harvesting and then distributing within the collective. If you as the club owner or the club itself, will not be handling any weed, it’s not really a DPC then, it’s basically a dagga-friendly private property that host events.

      From a legal perspective, I don’t think you’ll have any problems. People will probably not show up with kilograms of dagga and if each person has their stash in their own container, that is a strong defense against dealing and a great example of private use as a collective. Perfectly legal.

      Still nothing wrong with it, though and I’m sure you’ll have lots of traction. This is my opinion, completely open to be differed with!

      How many people do you want to invite to these events? I’d say under 20 to start with and maybe up to 60 at full throttle (seating is the main thing… it can be hired though).

      Will they all be known to you or will you be opening it to anyone who can buy a ticket? Pretty much anyone, I’d imagine there will be some sort of vetting beforehand (check age), but mainly to keep out the riffraff… aiming for a classy & upmarket yet unpretentious affair…

      Why then call it a club? You’re right, I just like the “Private Club” sound of it, i.e. it’s private and not open to just anyone… you have to be in the know (exclusive…if you know what I mean).

      So yes, in short – revenue will come from catering the event, maybe affiliate sales (of other Cannapreneur services or canna paraphernalia etc.)

      My main concern is: Aside from the legality around Cannabis – Is such a model legal in a residential area that is not zoned for “business” – or if that is a problem, is there some other workaround for it, like I’m just having a private party and receive “donations” for it?
