This Harm Reduction Guide is freely available for download by DPC Member Clubs.

We can all do our part in reducing the harms caused by prohibition, as well as reducing the risks of Cannabis use through education, safe practices, and community care. Both are essential. Get the whole guide by signing up your club with us today.

There are six important documents highlighted in the Harm Reduction Guide that we highly recommend printing out and having on hand when running your DPC.

The second one is The August 2023 National Police Directive

Why:
This directive, hard won by activists at the Phakisa Action Lab in May 2023, provides explicit
instructions on the enforcement of the Privacy Judgement. It clarifies officers’ roles, reinforces
the constitutional right to privacy, and warns against harassment or arbitrary arrests. Having it
on hand shows the latest police policy, which carries weight during raids.

Please be aware that there are other “directives” and arbitrary letters circulating on social media.
These are not official. You will always hear from us if there are important, verifiable
developments with the SAPS.

Key points to highlight:

*Respect for Privacy Rights

*Members are reminded that the Constitutional Court confirmed the right to privacy in
respect of the use, possession, and cultivation of Cannabis.

*Police cannot interfere with private Cannabis use unless there’s clear evidence of “dealing” (only
undercover operations can prove “dealing” in court).

*Intimidation, harassment, or unlawful arrest of individuals exercising their rights will not
be tolerated. Officers can be disciplined / held personally liable for harassment.

*Private Possession Not a Crime
Officers must refrain from arresting where cannabis possession is consistent with private
use. Simple possession or cultivation (no plant limits set, yet) are not grounds for arrest.

*Professional Conduct Required
Members are reminded to act in accordance with the Constitution and existing National
Instructions. Any deviation opens the officer to disciplinary action / personal liability.
