Yesterday we received a legal opinion published by the South African Police Service in KwaZulu Natal Province.

Unfortunately, there is some confusion whizzing around social media.

As usual.

This is a LEGAL opinion, so it is worded in legalese, a language that does not readily translate to common sense, especially on the interwebs. This opinion cites all sorts of laws and penalties, most of which are accurate. However, this one paragraph is completely inaccurate:

The Regulations published by the Minister of Health on 7 March 2025 were retracted on 25 March 2025.

Despite all this to-ing and fro-ing, the fact remains:

  • The sale of Cannabis is illegal in South Africa. 
  • This includes food & drinks containing intoxicating cannabinoids.

Some are seeing this latest “legal opinion” as a warning that there are raids to come. Well, there are enough “shops” in KZN to see this as a possibility. We have no idea what the SAPS are planning.
