What has become glaringly apparent of late is that so many people ( including the Cops) seem to have lost sight of what we ALL achieved in 2018 – The right to use, possess and cultivate Cannabis for personal use within private spaces. Trade Remains ILLEGAL. 

All people in South Africa have this constitutional right.

Nobody can buy or sell this right.

Our right to privacy is enshrined in our Bill of Rights.

Our freedom of association is also a constitutional right.

Your physical being, including your clothing & pockets, is your private space, no matter where you are.

Your car is your private space but not to consume, only to possess.
Your home, communal land, community space and religious establishments are all private spaces.

The police need an official warrant to enter or search any private space. Always check the warrant for the correct date, address & that it is signed.

In handing down his judgment, the Honourable Judge Zondo amended the order of the Western Cape High Court, Judge Davis, to extend the definition of a private space. The plaintiffs – Prince, Acton, Stobbs et al – had appealed for this in their founding affidavits to the constitutional court.

From the constitutional court website :

“They also sought leave to cross-appeal against the High Court’s decision to confine its order to the use or possession or purchase or cultivation of cannabis in a private dwelling. However, they contended that, if the High Court was right to confine its order of invalidity to the infringement of the right to privacy, it should not have confined this to a home or private dwelling because the right to privacy extends beyond the boundaries of a home.”

Dagga Private Clubs / Cannabis Social Clubs / Private Associations need to keep their venues PRIVATE, with access control so that is not just a front door to a shop.

We Thought it worth mentioning the recent landmark ruling, Jacobs v Minister of Police, in July 2025. The Johannesburg High Court has affirmed citizens’ rights to ‘’politely’’ question and record police officers performing their duties in public spaces. The judgment clarifies that individuals may document law enforcement activities without fear of arrest, provided they do not obstruct officers or interfere with their work.
